  • Social Security Disability

The Social Security Administration, or SSA, supervises our country’s social insurance program, which includes disability, retirement, and survivors’ benefits. These three programs are made possible through mandatory contributions subtracted from the finances of employers, employees, and self-insured people.

“In 2009, nearly 51 million Americans received $650 billion in Social Security benefits.”

How Social Security Works

While you are working, you pay taxes into the Social Security system, and when you retire or become disabled; you, your spouse and your dependent children receive monthly benefits that are based on your reported earnings. Also, your survivors can collect benefits in the event of your death.
The money you put into the Social Security system is not put into a personalized account with your name on it. Instead, the money you contribute is put into a massive trust for everyone and from this massive trust Social Security pays out all of its benefits.

There are two different forms of social security:
Social Security Disability
-social security disability provides income and benefits to people who have worked and paid social security taxes in the past, but are now too disabled to gain income.
Supplemental Security Income
-supplemental security income provides disabled individuals with income regardless of whether or not they have been employed in the past.

For both Social Security Disability and Supplemental Security Income, you must show that your disability will prevent you from gaining income or employment for at least one year.

The application process for Social Security Disability and Supplemental Security Income can be very difficult and long. The attorneys at Boyette, Cummins & Nailos, PLLC, will work with you and help you apply for the social security disability you need. Sometimes, legitimate claimants are denied social security disability because they fail to complete all the appropriate forms or provide convincing evidence of their disability.
