What is a Class Action Lawsuit?

A class action lawsuit is a situation in which a large number of people who have been affected either by a defective product, service, or who have been injured sue one or several people, corporations or other entities. The group of people – referred to as the “class” – alleges that the defendant is responsible for causing the negative outcome suffered by the “class.”

What is a Class Action?

A class action is a way for a group of plaintiffs that would be too big for a standard lawsuit to sue one or multiple defendants. A select number of “representative plaintiffs” file the actual suit and conduct the litigation, while the remaining plaintiffs are only contacted to allow them to opt out of the lawsuit or to be instructed on how to receive their share of the damages award.

If the defendant settles or they lose at trial, everybody who was affected by the defendant’s actions is given a percentage of the awarded damages, or if it is too difficult to contact everybody, a fund is made available to anyone who can demonstrate they were harmed as a result of the defendant’s actions.
